2. Services Provided

We offer professional photography services, including but not limited to lifestyle, athletic, and product photography. All bookings, pricing, and deliverables are subject to agreement between In Hawaii Photos and the client.

 

3. Booking & Payments

  • A retainer is required to secure a session. Full payment must be made before final image delivery.

  • Cancellations made less than 48 hours before the scheduled shoot may result in forfeiture of the retainer.

  • Late payments may incur a $50 late fee if not paid within 7 days of the due date.

 

4. Image Rights & Usage

  • Ownership: In Hawaii Photos retains the copyright to all images unless otherwise agreed in writing.

  • Client Usage: Clients receive a non-exclusive, limited-use license to use the photos for personal or commercial purposes as specified in the contract.

  • Restrictions: Images may not be edited, resold, or transferred to third parties without prior consent.

 

5. Liability & Disclaimer

  • We are not responsible for circumstances beyond our control, such as weather conditions, client delays, or equipment failures.

  • While we take every precaution to secure and back up files, we are not liable for data loss due to unforeseen technical issues.

 

6. Privacy & Data Handling

  • Personal information collected through bookings or inquiries is handled per our Privacy Policy.

  • We do not sell or share client data with third parties beyond service providers necessary to fulfill our work.

 

7. Changes to Terms

  • We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date.

 

8. Dispute Resolution

  • Any disputes will be resolved through negotiation first, followed by mediation/arbitration if necessary.
